Booking through TirthanValleyStay

If you are making a booking through our website, that booking is made with the property you have booked. We only act as a facilitator and we are not involved in setting the prices, descriptions, and amenities of properties you book. Our involvement is limited to providing an interface you can use to make your booking and assist you via our team of travel assistants during the booking process and your trip.

Eligibility of use

You must be at least 18 years of age and have the legal authority to enter into an agreement to use our services. If you are below the age of 18 years, a person or guardian with legal contracting age can use our website and services on your behalf.We reserve the right to restrict your access to the website if it is found that you are a minor or below the legal contracting age.

All the content provided on the website including but not limited to text, images, icons, UI, and other similar content belongs to TirthanValleyStays and respective property owners. You cannot use, reproduce, or modify the content for any other purpose described herein. We do not provide any right to the user to utilize the content. By ‘make a booking,’ we only provide a digital platform for booking a requested room(s) in a property. Thus, the ultimate liability rests on the respective property owners and not us.

  • We assume no liability for the standard of services provided by the property owners.
  • We provide no guarantee of the availability of rooms at the property at the time of check-in.
  • We do not guarantee the availability or correctness of any information provided on our website.
Any issues faced by you at the time of availing such service will be the sole responsibility of the property owners. We cannot be held responsible for any errors, omissions, denial, breaches, or negligence on the part of the property owners.

Your responsibility

You are advised to be vigilant and check all the relevant information related to our services before making a booking. You agree to be bound by all the conditions mentioned in this policy and other policies provided on the website.

You further undertake to comply with all applicable laws and regulations issued by the government, district authorities and other statutory bodies while availing services from our website.

We will use it to send booking details, confirmation or cancellation of bookings, payment, refund, schedule updates or any other communication at the time of booking.We may use your number to assist you or gain feedback during the trip with our team of ‘travel assistants’ who will contact you only if you choose to allow it.
We may also use this number to send marketing material and insights which we believe will help you during your trip. You unconditionally consent that such communications via SMS, WhatsApp, voice call or any other mode by us are:
  • upon your request and proper authorization
  • in compliance with the relevant guidelines of TRAI or other authorities in India
You will indemnify us against all types of losses and damages due to any action taken by TRAI or any other authority due to any wrong complaint raised by you related to the communications mentioned above.

Data security

You understand that the phone number or any information that you provide to us on the website may be read by others due to any breach of security at your end.
We strive to adopt the best security measures on our website to keep your data secure. However, we cannot guarantee that there will be no security breach on our website that can put your information at risk.
Your data available with us may be shared with concerned authorities and law enforcement agencies for any investigation purpose without your consent.

Force majeure

There can be circumstances where we may be unable to honor the confirmed bookings like the act of God, insolvency, a pandemic/epidemic, business issues, government decisions, or any operational and technical issues which are beyond our control. You agree that we are just a facilitator website and cannot be held responsible for any such Force Majeure situations.
In the event of non-confirmation of booking due to any technical or operational issues, you agree that we are only liable to repay the amount you have given us, if any, for the booking. Such a refund will completely discharge us from all liabilities with respect to that transaction and further any liability, if any, will be borne by you.

Right to refusal

We, at our sole discretion, reserve the right to not accept any booking request by you without assigning any reason thereof. We may not provide any further service or confirm the booking until you provide complete consideration or in situations where:

  • We are unable to verify your identity
  • You are in breach of any applicable law which results in liability on you, any other person or us.
You agree that property owners may refuse to provide the booking confirmed on our website without assigning any reason including but not limited to behavioral issues, health hazards, public safety, pandemic/epidemic, and government orders. In such cases, the property owner will be completely liable as it is outside our purview. You also agree that any claim or refund against such refusal shall be the responsibility of the property owner and not us.

Indemnification

You agree to indemnify, defend, and hold harmless TirthanValleyStay, our affiliates, officers, directors, and lawful successors against any losses, expenses, liabilities, claims, and damages asserted against, arise out of, result from, or any breach of any representation or warranty provided by you, or non-performance of any agreement by you.
